  1. Basic Provision

    • Pivovarský dům, s.r.o., Company ID 25141236, with its registered office in Lípová 511/15, Nové Město, 120 00 Prague 2 (hereinafter referred to as the ‘Controller’) is the Data Controller under Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the ‘GDPR’).

    • Personal Data means any information about an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as name, identification number, location data, network identifier, or one or more specific physical, physiological, genetic, psychological, economic, cultural or social identity elements of the natural person.
  2. SOURCES AND CATEGORIES OF PROCESSED PERSONAL DATA

    • The Controller processes the personal data you have provided to them or the personal data that the Controller has obtained by fulfilling your order.
    • The Controller processes your identification and contact data and data necessary to perform the contract.
  3. LEGAL REASON AND PURPOSE OF PERSONAL DATA PROCESSING

    • The legal reason for processing your personal data is:
      1. performance of the contract between you and the Controller pursuant to Article 6(1)(b) of the GDPR,
      2. the legitimate interest of the Controller in providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(f) of the GDPR,
      3. your consent to processing for the purpose of providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(a) of the GDPR in conjunction with Article 7(2) of Act No 480/2004 Coll., on certain information society services, in the event that no goods or services were ordered.
    • The purpose of personal data processing is to:
      1. process your order and exercise the rights and obligations arising from the contractual relationship between you and the Controller; when ordering, personal data required for successful execution of the order (name and address, contact) are required, the provision of personal data is a necessary requirement for the conclusion and performance of the contract; the contract cannot be concluded or performed by the Controller without the provision of your personal data,
      2. send commercial communications and carry out other marketing activities,
      3. no individual decision-making within the meaning of Article 22 of the GDPR is made by the Controller.
  4. Data Storage Period

    • The Controller stores your personal data:
      1. for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the Controller and the exercise of claims under these contractual relationships (for a period of 15 years from the termination of the contractual relationship),
      2. for as long as the consent to the processing of personal data for marketing purposes is withdrawn, not longer than 15 years if personal data are processed on the basis of your consent.
    • The Controller deletes your personal data when the personal data storage period expires.
  5. RECIPIENTS OF PERSONAL DATA (CONTROLLER’S SUBCONTRACTORS)

    • The recipients of personal data are persons:
      1. involved in the delivery of goods / services / payments on the basis of the contract,
      2. providing online shop operation services and other services related to online shop operation,
      3. providing marketing services.
    • The Controller does not intend to transfer your personal data to a third country (outside the EU) or an international organization.
  6. Your Rights

    • Under the terms of GDPR, you have:
      1. the right to access your personal data under Article 15 of the GDPR,
      2. the right to rectify your personal data under Article 16 of the GDPR, or to limit the processing under Article 18 of the GDPR,
      3. the right to delete personal data under Article 17 of the GDPR,
      4. the right to object to the processing under Article 21 of the GDPR,
      5. the right to data portability under Article 20 of the GDPR,
      6. the right to withdraw your consent to the processing in writing or electronically to the address or email of the Controller specified in Article III of this Privacy Policy.
    • Furthermore, you have the right to lodge a complaint with the Office for Personal Data Protection if you believe your right to the protection of personal data has been infringed.
  7. PERSONAL DATA SECURITY CONDITIONS

    • The Controller declares that all appropriate technical and organizational measures were taken to secure your personal data.
    • The Controller took technical measures to secure data storage and personal data storage.
    • The Controller declares that only the persons authorized by them have access to personal data.
  8. Final Provisions

    • By submitting an order from the online order form, you acknowledge that you are familiar with the Privacy Policy and accept it in its entirety.
    • The Controller is entitled to change this Privacy Policy. The Controller will publish a new version of the Privacy Policy on their website and send you a new version of this Privacy Policy to your email address provided to the Controller.
The Privacy Policy shall take effect on 1 January 2019.
